These protections do not make every used car fault free. Reasonable expectations depend on factors such as the vehicle’s age, price and disclosed condition.

If a problem arises, contact the dealer promptly. The appropriate remedy depends on the circumstances; a refund is not automatic for every fault.

What changes when you buy privately?

Buying from a genuine private seller usually means the Consumer Guarantees Act and Fair Trading Act do not apply. There may be other legal remedies, including for misrepresentation, but resolving a problem can be more difficult.

A private sale may offer a lower price. Weigh that against the vehicle’s condition, the checks you need to arrange and the support available afterwards. Verify the seller’s identity and right to sell the car, and check for outstanding finance before paying. Someone advertising as a private seller may actually be a trader, so confirm who you are dealing with.

What should you check before buying any used car?

The same careful approach helps whether you buy from a dealership or privately:

  • Review available service records and ask about previous repairs, damage and modifications.
  • Check the vehicle’s identity, history and whether money is owing on it.
  • Take a test drive and assess visibility, seating comfort, braking and how it drives.
  • Arrange an independent pre-purchase inspection.
  • For an EV or plug-in hybrid, ask about battery health, charging and remaining battery warranty.
  • Read the agreement and record any promises about work to be completed before collection.

A current WOF checks specified safety requirements; it is not a full mechanical inspection or a guarantee of future reliability. Consider both safety information and mechanical condition before deciding.

The advertised price is only part of the decision. Allow for insurance, maintenance and any tyres or repairs the vehicle may need. If you are borrowing, compare interest, fees, the loan term and the total amount payable.
